Klipo Terms of Use

1. Agreement and the Klipo Service

These Terms of Use ("Terms") are an agreement between you and Furkan Tosun ("Furkan Tosun," "I," "me," or "my"). They apply to your access to and use of the Klipo iOS application and related websites, services, content, and features (together, the "Service").

Klipo provides a curated library of creative templates and tools that let you submit selected photos and receive AI-generated images or videos. The Service may also include a private Library, generation history, credits, subscriptions, notifications, reporting tools, and other features that I may add, remove, or change.

By downloading, accessing, or using Klipo, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, to use Klipo's AI generation and paid features. You may not use the Service if applicable law or the rules of an AI provider prohibit you from doing so. You are responsible for ensuring that your use of Klipo is lawful in your location.

Klipo is not designed for children. If you believe a child has used the Service in violation of this section, contact support@tulparfoundry.com.

3. Anonymous accounts and device security

Klipo automatically creates an anonymous, device-linked account so it can provide the Service, protect your media, maintain your Library, and track credits and subscription entitlements. You do not need to provide an email address, password, or social-media login.

Your account and device identifier are personal to you. You may not sell, transfer, share, or allow another person to use your account. You are responsible for keeping your device and Apple Account secure. Local photos, caches, pending uploads, and generated results are not a backup service.

You may request permanent account deletion from Settings → Delete Account. Deleting your Klipo account does not cancel an Apple subscription; see Section 8.

4. License to use Klipo

Subject to these Terms, I grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use Klipo on Apple devices that you own or control for lawful personal use.

Except as expressly allowed by these Terms or applicable law, you may not copy, modify, distribute, sell, lease, sublicense, publicly display, reverse engineer, decompile, disassemble, scrape, frame, or create derivative works from Klipo or any part of it. You may not use automated tools to extract templates, previews, metadata, or other Service content, or use Klipo to build a competing service.

5. Photos, user content, and generated results

Your photos and other content

You retain the rights you already have in photos, videos, text, and other materials that you submit to Klipo ("User Content"). By submitting User Content, you instruct me and the Service providers described in the Privacy Policy to host, transmit, analyze, transform, and process it only as reasonably necessary to operate the requested feature, protect the Service, comply with law, and enforce these Terms.

You represent and warrant that you own or have all permissions, licenses, and consents needed to submit the User Content and to permit this processing. In particular, you must have permission from each person shown in a photo where such permission is required. You must not submit confidential information or another person's personal data without a lawful basis and the necessary consent.

Generated results

To the extent I own any rights in a result generated for you, I grant you a non-exclusive, worldwide, royalty-free license to use, save, and share that result for lawful personal or commercial purposes, subject to these Terms, third-party rights, applicable law, and the terms of any underlying model or service provider.

AI-generated results may not be eligible for copyright protection, may not be unique, and may resemble results generated for other users. I do not promise that a result is exclusive, accurate, suitable for a particular purpose, or free of third-party rights. You are responsible for reviewing a result before you publish, sell, or otherwise rely on it.

6. Prohibited content and conduct

You may not use Klipo to create, upload, request, store, share, or distribute content or to engage in conduct that:

• is illegal, fraudulent, defamatory, threatening, harassing, hateful, abusive, or intended to intimidate or harm another person;
• sexualizes, exploits, or harms a child or depicts sexual content involving a minor;
• creates or distributes non-consensual intimate imagery, sexualized depictions of a person without consent, or deceptive impersonations intended to harm or defraud;
• uses another person's face, likeness, name, voice, private information, or identity without the rights or consent required by law;
• infringes copyright, trademark, privacy, publicity, trade-secret, or other rights;
• promotes violence, exploitation, trafficking, self-harm, terrorism, or other dangerous or unlawful activity;
• contains malware, harmful code, or attempts to disrupt, overload, probe, bypass, or defeat Service security or content safeguards;
• scrapes or systematically collects Service data, resells access, or uses Klipo for a competing product; or
• violates the applicable rules of Apple, fal.ai, another technology provider, or any law or regulation.

7. Safety, moderation, reports, and enforcement

Klipo may use automated safety checks and service-provider moderation. I do not promise that every prohibited or harmful item will be detected before processing, and moderation may occasionally block a lawful request or fail to produce a result.

You can report a generated result through the in-app reporting feature or by contacting support@tulparfoundry.com. I may remove content, cancel a generation, withhold or refund credits where appropriate, limit access, or suspend or terminate an account when reasonably necessary to protect users, comply with law, respond to a report, or enforce these Terms.

8. Subscriptions, trials, and credits

Apple subscriptions

Klipo may offer auto-renewable weekly and annual subscription plans through Apple's In-App Purchase system. The exact subscription name, duration, price, taxes, included features, credit amount, and any trial or introductory offer will be shown before you confirm the purchase. The purchase screen and Apple’s subscription information control if they differ from a general description in these Terms.

Unless you cancel, an auto-renewable subscription renews automatically for the same period. Apple charges your Apple Account within 24 hours before the current period ends. If a free trial or introductory offer is available, it converts to the paid plan disclosed at sign-up unless you cancel at least 24 hours before the trial or offer ends. Eligibility for offers is determined by Apple and may be limited to one offer per Apple Account.

You can cancel or manage a subscription in iPhone Settings → your name → Subscriptions or at Apple's subscription management page. Canceling stops future renewal but normally does not provide a refund for the current period or unused time, except where required by law or approved by Apple.

Credits

Some plans include non-cash digital credits used to request generations. Credits are personal, non-transferable, have no cash value, cannot be sold or exchanged, and do not create a deposit or property right. Credit amounts, generation costs, reset or expiration rules, and any refund rules will be disclosed in the app when relevant. Unless applicable law requires otherwise, unused credits are not refundable and may reset or expire as disclosed for the selected plan.

Deleting your account may permanently remove unused credits, pending jobs, and access to results. Deleting your Klipo account does not cancel an Apple subscription, and an Apple subscription may continue to renew until you cancel it through Apple.

Payments and refunds

Apple processes App Store purchases and controls billing, payment methods, tax collection where applicable, and refunds. For a refund request, use Apple's report-a-problem service or contact Apple Support. Nothing in these Terms limits any non-waivable consumer or refund rights that apply to you.

9. Privacy, retention, and deletion

The Privacy Policy explains what information Klipo and its service providers handle, why it is handled, where it may be processed, and how long it is retained. By using AI generation, you acknowledge that the selected media must be transmitted to the AI processing providers needed to create the requested result.

Temporary uploaded photos are normally deleted after the relevant generation lifecycle and are subject to the retention periods described in the Privacy Policy. Generated videos may be retained for a limited period and may become unavailable after that period. Save any result you want to keep to your device or another location you control.

Account deletion can take time to complete. After a deletion request is accepted, Klipo blocks the old account and processes deletion within 30 days, subject to the limited records that I may be required or permitted to retain by law, security, fraud prevention, accounting, tax, dispute resolution, or Apple transaction requirements.

10. Intellectual property and feedback

Klipo, its software, design, name, logo, templates, curated feed, preview media, text, graphics, and other Service materials are owned by or licensed to Furkan Tosun and are protected by intellectual-property laws. These Terms do not transfer any ownership of those materials to you.

If you send suggestions, ideas, or feedback, you allow me to use them without restriction or compensation to improve Klipo, provided that this permission does not grant me ownership of your User Content or personal data beyond what is described in the Privacy Policy.

11. Copyright complaints

If you believe material available through Klipo infringes your copyright, send a notice to support@tulparfoundry.com with: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and where it appears; (d) your contact information; (e) a good-faith statement that the use is not authorized; and (f) a statement that the information in your notice is accurate and that you are authorized to act for the rights holder.

12. Third-party services

Klipo depends on third parties, including Apple, hosting and authentication providers, payment and subscription providers, notification services, analytics providers, and AI model providers. Their services may have separate terms and privacy notices. I am not responsible for third-party services that I do not control, including delays, outages, policy decisions, or changes made by those providers.

13. Availability, changes, and no backup

The Service may be unavailable, delayed, interrupted, changed, or discontinued for maintenance, safety, legal, technical, business, or provider-related reasons. Generation times are estimates, not guarantees. A request may fail, be queued, be rejected by a safety system, or produce a result different from what you expected.

Klipo is not a backup, archival, storage, medical, legal, financial, employment, identity-verification, or safety-critical service. Do not rely on Klipo for decisions or situations where an error or unavailability could cause injury, loss, or damage.

14. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL RESULTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. I DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND THAT THE SERVICE OR RESULTS WILL BE ERROR-FREE, UNINTERRUPTED, OR SUITABLE FOR YOUR NEEDS.

Nothing in these Terms excludes or limits a warranty, guarantee, right, or remedy that cannot lawfully be excluded or limited in your place of residence.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FURKAN TOSUN WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR CONTENT, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THROUGH APPLE FOR KLIPO IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

These limits do not apply to liability that cannot be limited under applicable law, including liability for fraud, intentional misconduct, or personal injury caused by negligence where such limitation is prohibited.

16. Your responsibility and indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Furkan Tosun from claims, losses, liabilities, costs, and expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of another person's rights or applicable law. This obligation does not apply to the extent a claim was caused by my own unlawful conduct or liability that cannot legally be shifted to you.

17. Suspension and termination

You may stop using Klipo at any time. I may suspend or terminate your access, delete content, or discontinue the Service if I reasonably believe it is necessary for safety, security, legal compliance, provider requirements, abuse prevention, or a breach of these Terms.

Termination does not automatically cancel an Apple subscription or create a refund obligation. Sections that by their nature should continue—including intellectual property, content responsibility, disclaimers, limitations of liability, indemnity, and dispute-related provisions—will continue after termination.

18. Changes to these Terms

I may update these Terms when Klipo, its providers, or applicable law changes. I will update the “Last updated” date and provide additional notice for material changes where required. If you continue to use Klipo after revised Terms take effect, you accept the revised Terms. If you do not agree, stop using the Service and cancel any subscription through Apple.

19. Apple-specific terms

This section applies when you use Klipo on an Apple device:

• You acknowledge that these Terms are between you and Furkan Tosun, not Apple. Apple is not a party to these Terms and is not responsible for Klipo or its content.
• Your license to use Klipo is limited to a non-transferable license to use the app on Apple devices that you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for Klipo. Furkan Tosun is solely responsible for support, product claims, warranties, and applicable legal or regulatory claims relating to Klipo.
• If a third party claims that Klipo or your permitted use of Klipo infringes intellectual-property rights, Furkan Tosun—not Apple—is responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms and applicable law.
• Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to Klipo, and Apple may enforce these Apple-specific terms against you.
• You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government restricted-party list, and that you will comply with applicable export and sanctions laws.

20. General terms

These Terms and the Privacy Policy are the entire agreement between you and Furkan Tosun regarding Klipo, except for terms presented to you in connection with a specific purchase or feature. If any provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. My failure to enforce a provision is not a waiver of my right to enforce it later.

Nothing in these Terms removes mandatory consumer protections or prevents you from using a legal right available in the courts or forum required by the law that applies to you.
